Is registering my trademark really necessary?

I get asked this question all the time- and the answer is generally NO, unless you plan on selling across state lines or internationally.  The benefit of registering a trademark is that is stakes a claim across the country for your mark used in connection with your goods or services.  This is true, even if you have not sold or advertised your products/services in the various states.  By registering your trademark, you have put others on notice of your rights.  If you are a business limited to just one city or even state, you can rely on either a state registration or common law to protect your rights in a particular trademark.  Given the relative costs, if you have any plans of expansion, you should seriously consider registering your trademark.
